Terms & Conditions
This Agreement ("Agreement") is entered into between APPALACHIAN HYDROSEEDING AND LANDSCAPING, INC. ("Contractor") and the undersigned Client ("Client").

At Appalachian Hydroseeding & Landscaping, Inc., we believe in transparent, straightforward pricing. Here’s what that means for you:
✅ No Sales Tax — Hydroseeding and erosion control are professional services, not taxable goods. What you’re quoted is what you pay.
✅ No Credit Card Fees — We absorb processing costs so you never pay a surcharge for the convenience of paying by card.
1. Deposit and Payment Terms

A standard upfront deposit of 50% is required and is nonrefundable. Pricing is valid for 30 days from the date of the estimate.

By providing a credit card, the Client authorizes Appalachian Hydroseeding & Landscaping, Inc. to securely retain the card on file and charge the full remaining balance on the same day as job completion.

Upon job completion, you will receive an emailed receipt confirming the completed work and payment processed.

If the card on file is declined, payment is due within 48 hours. Failure to remit payment within 48 hours will result in a 10% late fee applied to the outstanding balance immediately, with an additional 2% applied every 7 days thereafter until the balance is settled in full. Any future scheduled work will be suspended until the balance is settled.

Persistent late payments may result in legal action to recover outstanding amounts, with all associated legal fees borne by the delinquent party.
2. Measurements & Site Conditions

Measurements are subject to a 10% variance.

If site conditions change between our initial assessment and the scheduled work date (including additional areas requiring hydroseeding, vegetation growth, or grading modifications), Appalachian Hydroseeding & Landscaping, Inc. reserves the right to reassess the property and adjust the scope of work accordingly. Any changes require mutual written agreement on revised costs, and an additional deposit may be required before work can begin or continue. Appalachian Hydroseeding & Landscaping, Inc. may suspend work until a revised agreement is reached and any required additional payment is received.
3. Call 811

It is the Client’s responsibility to ensure all utility lines are appropriately flagged prior to a job that includes digging or excavation.

A rescheduling fee of $250 will be assessed for negligence or failure to comply.

If there’s any areas to avoid that are not marked by 811 (septic tanks, gutter drains, etc.) we ask that you clearly mark it.
4. Delays & Concealed Contingencies

Delays due to inclement weather are not the responsibility of Appalachian Hydroseeding & Landscaping, Inc.

Prices quoted do not include work resulting from concealed contingencies, which will be billed at standard hourly rates with materials at cost.
5. Provisions
-
Client agrees to provide access to water and electricity at no charge to the Contractor for the duration of the work.

Client ensures site access during working hours without interference.

Appalachian Hydroseeding & Landscaping, Inc. reserves the right to request movement of items for job efficiency.
6. Change Orders and Fees

Any alterations to the agreed scope of work require a written, signed change order and will result in additional billing.
7. Damages & Underground Hazards
-
Appalachian Hydroseeding & Landscaping, Inc. is not responsible for damage to any underground utilities, irrigation systems, invisible pet fences, drainage pipes, septic lines, or any other unmarked, undisclosed, or improperly marked underground features or impediments.

Any Client property moved to facilitate the work is moved at the Client’s own risk.

It is the Client’s responsibility to disclose all known underground features prior to work commencement.
8. Germination & Results Disclaimer

Hydroseeding results are dependent upon environmental conditions, weather, adequate watering, soil quality, and other factors outside the control of Appalachian Hydroseeding & Landscaping, Inc. We do not guarantee germination rates, uniformity of growth, color consistency, or specific aesthetic outcomes.

Appalachian Hydroseeding & Landscaping, Inc. shall not be held liable for germination failure resulting from drought, insufficient irrigation, erosion, acts of nature, or any condition beyond our reasonable control.

It is the Client’s sole responsibility to provide adequate and consistent watering following service completion. No recourse shall be available to the Client where inadequate watering is determined to be a contributing factor.

Appalachian Hydroseeding & Landscaping, Inc. cannot be held responsible for cross-contamination from wind, water, wildlife, or natural seed migration causing other grass varieties to grow within the hydroseeded area.
9. Plant Material & Sod

Appalachian Hydroseeding & Landscaping, Inc. does not warrant any plant material, sod, seed, or living organic materials installed or applied.

The survival of plant material is dependent on factors outside our control including weather, irrigation, soil conditions, and Client maintenance.
-
No replacements or refunds will be issued for plant loss after installation.
10. No Warranty
-
Appalachian Hydroseeding & Landscaping, Inc. does not offer any express or implied warranty on hydroseeding, erosion control, or landscaping services performed. All work is provided as-is based on site conditions at the time of service.
11. Pesticide & Herbicide Notification
-
When pesticide or herbicide applications are part of the scope of work, the Client will be notified in advance.

Clients, children, and pets should remain off treated areas for a minimum of 24 hours following application or as directed by product labeling.
-
Appalachian Hydroseeding & Landscaping, Inc. is not liable for any adverse effects resulting from failure to observe re-entry restrictions.
12. Erosion Control Maintenance

Erosion control measures installed by Appalachian Hydroseeding & Landscaping, Inc. (including silt fencing, matting, and sediment barriers) require ongoing maintenance to remain effective.

Unless a maintenance agreement is in place, the Client assumes full responsibility for the upkeep, repair, and compliance of all installed erosion control measures following installation.
13. Photographs of the Project

The Contractor may document and use project images for promotional and marketing purposes.
14. HOA Bylaws
-
The Client is responsible for providing written notice of any relevant HOA Bylaws, Conditions, or required Permissions prior to commencement of work.
15. Site Readiness, Access & Rescheduling
-
The job site must be fully prepared and accessible at the scheduled time.
-
If the site is not cleared, accessible, or properly marked, or if gates are locked without advance notice, or if incorrect directions were provided, a service charge of $150–$200 will be assessed.

Appalachian Hydroseeding & Landscaping, Inc. reserves the right to assess applicable mobilization charges before rescheduling any affected appointments.
16. Mobilization Fees for Out-of-Area Jobs

For projects outside Haywood County, a mobilization fee of $100 to $400+ will be assessed based on the job’s location and total drive time.
17. Subcontractors
-
Appalachian Hydroseeding & Landscaping, Inc. reserves the right to engage qualified subcontractors to perform any portion of the agreed scope of work.

All subcontracted work is held to the same standards as work performed directly by our team.
18. Limitation of Liability
-
In no event shall Appalachian Hydroseeding & Landscaping, Inc. be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to services performed.

The total liability of Appalachian Hydroseeding & Landscaping, Inc. for any claim arising under this Agreement shall not exceed the total amount paid by the Client for the specific services giving rise to the claim.
19. Amendments

These terms and conditions are subject to change. Any amendments will be communicated to the Client in writing.
20. Governing Law
-
This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina.

Agreement
By paying the deposit and confirming approval of the estimate, the Client acknowledges understanding and acceptance of these Terms and Conditions. By providing a credit card, the Client further authorizes Appalachian Hydroseeding & Landscaping, Inc. to charge the card on file upon job completion as described herein. Please retain a copy of this Agreement for your records.

Payment of the deposit constitutes the Client’s full agreement to these Terms and Conditions.

Note: No verbal agreements will be honored; all agreements must be in writing. Delinquent payment may result in suspension or termination of any scheduled or future services. Appalachian Hydroseeding & Landscaping, Inc. reserves the right to make necessary field adjustments for job efficiency.
